Terms of Service

These terms govern your use of Lomero's short-form video transcription and hook analysis platform.

By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

1.1 Eligibility

You must be at least 16 years old to use the Service.

1.2 Permitted Use

  • Transcribe publicly accessible Instagram Reels, TikTok videos, and YouTube Shorts for personal, educational, research, or commercial purposes
  • Run hook and structural analysis on transcribed content for content strategy
  • Download, export, and repurpose your own transcripts
  • Integrate with the Lomero MCP server where available

1.3 Prohibited Use

  • Infringe intellectual property rights of creators whose content you submit
  • Scrape or bulk-extract in violation of Instagram, TikTok, or YouTube Terms of Service
  • Reverse engineer the Service
  • Engage in illegal activity including harassment or defamation
  • Attempt unauthorized access to our systems
  • Circumvent rate limits or waitlist gating
  • Use the Service to train competing AI models
  • Misrepresent the output generated by the Service as original human-authored work without disclosure

2. Accounts and Access

2.1 Open Tools

Some Lomero tools are available without an account, subject to fair-use limits and rate limiting. We may modify or restrict these tools at any time.

2.2 Waitlist and Full Access

Full access is currently invite-only via a waitlist managed through Clerk. Joining the waitlist does not guarantee access. We approve invitations at our discretion based on capacity and product fit.

2.3 Future Paid Plans

Lomero does not currently charge for the Service. If paid plans are introduced in the future, they will be governed by additional terms made available at the time of launch, including pricing, billing cycles, and cancellation policies. We will not enroll any existing user in a paid plan without explicit consent.

2.4 Account Security

You are responsible for maintaining the security of your account credentials and all activity under your account. Notify support@lomero.app immediately if you suspect unauthorized access.

3. Content and Intellectual Property

3.1 Your Content

You retain full ownership of transcripts and analysis you generate. You grant Lomero a limited, non-exclusive license to process submitted URLs solely to provide the Service.

3.2 Third-Party Content (Reels, TikToks, Shorts)

Transcription generates a text representation of third-party video content. You are responsible for compliance with copyright law and the Terms of Service of the source platform (Instagram, TikTok, or YouTube). We strongly recommend obtaining permission before republishing, providing attribution, and using transcripts for analysis or research rather than verbatim republication.

3.3 Lomero's Intellectual Property

The Service — including its design, AI models, software, branding, and documentation — is owned by Lomero and protected by applicable intellectual property laws.

4. Third-Party Services and Integrations

Lomero integrates with the Instagram, TikTok, and YouTube platforms as sources of publicly accessible video content, with Clerk for authentication and waitlist management, with Anthropic/Claude for optional MCP integration, and with Vercel for hosting and analytics. We are not responsible for their availability, accuracy, or conduct.

5. Availability and Modifications

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice, perform scheduled maintenance, and change the structure of the Service.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind.

We do not warrant:

  • 100% transcription accuracy
  • Error-free AI results
  • Uninterrupted availability
  • That analyzed content does not infringe third-party rights

7. Limitation of Liability

To the maximum extent permitted by law, Lomero shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Total liability is limited to the greater of (A) the amount paid to Lomero in the 12 months prior to the claim, or (B) USD $50.

8. Indemnification

You agree to indemnify and hold harmless Lomero from claims arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.

9. Governing Law and Disputes

These Terms are governed by the laws of Thailand. Disputes shall be submitted to the competent courts of Bangkok, Thailand. EEA users may lodge complaints with their local data protection authority.

10. Changes to These Terms

Changes will be notified via the “Last Updated” date at the top of this page. For material changes, we will also notify you via email.
